of the Editorial Team of the mass media - online publication of a scientific journal
"Personalized Psychiatry and Neurology"

1. General Provisions

1.1. This Charter defines the organizational, economic, legal and social foundations of the Editorial Office in accordance with Article 20 of the Law of the Russian Federation "On the Mass Media".

1.2. The editorial team of the journal "Personalized Psychiatry and Neurology" (hereinafter referred to as "Editorial Team") carries out the production and publication of the mass media - the scientific journal "Personalized Psychiatry and Neurology" (hereinafter referred to as "media").

1.3. The mass-media was registered on June 13, 2019 y. (registration certificate EL No. FS 77-76024) with the Federal Service for Supervision of Communications, Information Technology and Mass Media (Roskomnadzor).

1.4. The Federal State Budgetary Institution National Medical Research Center for Psychiatry and Neurology named after V.M. Bekhterev  of the Ministry of Health of the Russian Federation (FSBI “NMRCPN named after VM Bekhterev” of the Ministry of Health of Russia) is the Founder and Publisher of the mass media.

1.5. The Editorial Team is not a legal entity, an independent economic entity and carries out economic activities as a structural unit (FSBI "NMRCPN named after VM Bekhterev" of the Ministry of Health of Russia) (hereinafter referred to as the "Founder").

1.6. The Editorial Team carries out activities for the production and release of mass media on the basis of professional independence. Management of the Editorial Team is carried out in accordance with this Charter and other documents of the Founder.

1.7. Financing of the activities of the Editorial Team is carried out by the Founder in the manner prescribed by this Charter and other documents of the Founder.

1.8. For obligations arising from the activities of the Editorial Team, the Founder is responsible for all property belonging to him, acts as a plaintiff and defendant in court, arbitration court.

1.9. The editorial office is independent of political parties and other public associations pursuing political goals.

2. Goals, objectives and directions of the Editorial Team

2.1. Purpose of the Editorial Team is promotion of scientific achievements of scientists of the Federal State Budgetary Institution “NMRCPN named after V.M. Bekhterev" of the Ministry of Health of Russia, russian and foreign research and educational institutions;

2.2. The main tasks are:

  • publication of scientific materials of theoretical and practical significance which are prepared at a high scientific level;
  • ensuring a wide exchange of scientific information between FSBI "NMRCPN named after V.M. Bekhterev" of the Ministry of Health of Russia, russian and foreign research and educational institutions in the field of psychiatry, neurology, addiction diseases, fundamental and clinical pharmacogenetics and related disciplines;
  • increasing the creative and publication activity of young scientists.

2.3. The activities of the Editorial Team are:

  • production and release of mass media at a professional level in the directions indicated in the journal;
  • information activities;
  • timely implementation of all mass media publishing processes.

 

3. Rights and obligations of the Founder

3.1. The Founder exercises his rights in accordance with the Law of the Russian Federation dated December 27, 1991 No. 2124-1 "On the Mass Media" (hereinafter referred to as the Law on Mass Media) and this Charter.

3.2. The Founder has the right to:

  • approve the Charter of the Editorial Team, approve changes and additions to the Charter of the Editorial Team adopted on the basis of the decision of the Editorial Team;
  • terminate or suspend the activities of the mass media in the cases and in the manner established by this Charter and the legislation of the Russian Federation;
  • determine the language, subject matter and specialization, frequency and volume of the mass media, territory and form of periodic distribution of the mass media;
  • appoint and dismiss the Editor-in-Chief in accordance with the procedure established by this Charter;
  • change, in the prescribed manner, the subject matter and specialization, the language of the mass media, its name, the form or territory of the mass media distribution, its frequency, volume and circulation;
  • display messages and materials on their own behalf free of charge and within the period specified by them (statement of the Founder). The maximum volume of the statement of the Founder can’t exceed ½ page of the mass media;
  • monitor the compliance of the activities of the Editorial Team with the provisions of the legislation, this Charter and other documents of the Founder, for the compliance of the subject matter and specialization, language, frequency and volume of the mass media;
  • act as a publisher,
  • comply with the provisions of this Charter;
  • render assistance to the Editorial Team in the study of public opinion, media advertising, in the organization and conduct of mass events, including with the participation of readers, in the manner determined by the Founder;
  • not to interfere in the professional activities of the Editorial Team, except for the cases provided for by legislation, this Charter.

3.3. The Founder can transfer his rights and obligations to third parties with the consent of the Editorial Team.

3.4. The Founder is obliged:

  • comply with the provisions of this Charter;
  • not to interfere in the professional activities of the editorial office, except for the cases provided for by legislation this Charter;
  • make changes to the record of the mass media registration or send a notification to the registering authority upon the occurrence of the events provided for in Art. 11 of the Law on Mass Media.

3.5. The Founder is responsible for claims and actions related to the statement of the Founder (in accordance with Article 18 of the Law on Mass Media).

3.6. The Founder is liable for violation of the legislation of the Russian Federation about the mass media.

 

4. Rights and obligations of the Editorial Team

4.1. The Editorial Team has the right to independently:

  • plan its activities within the framework of the subject, specialization and direction of the mass media approved by the Founder, to resolve issues of its content and decoration;
  • carry out, in accordance with the established procedure, contractual relations with authors;
  • attract creative and technical workers who are not on the staff of the Editorial Team to perform certain tasks;
  • sign the mass media issue for the set, for printing and for publication; in accordance with the established procedure, carry out correspondence with readers of the mass media, take into account their interests and suggestions.

4.2. The Editorial Team is obliged:

  • provide a high content, scientific, artistic and professional level of publications;
  • carry out registration of materials for printing in accordance with the requirements of standards, technical specifications, other regulatory documents and contracts with a printing company, print distribution authorities and other organizations;
  • ensure compliance with the approved production schedules;
  • publish the statements of the Founder in full and within the terms specified by him.
  • respect all the rights and legitimate interests of third parties, as well as observe the rights on the works used, including copyright and related rights;
  • post the output of the mass media in accordance with Art. 27 of the Law on Mass Media;
  • display in the mass media the obligatory messages provided for in Art. 35 of the Law about the mass media;
  • post in the mass media a refutation of information disseminated by the mass media, if the Editorial Team does not have evidence that this information is true;
  • in accordance with Art. 19.2 of the Law on Mass Media to provide once a quarter (reporting period) information on the receipt of funds from a foreign state, an interstate organization, a foreign organization, from a non-profit organization performing the functions of a foreign agent in accordance with the legislation of the Russian Federation, a foreign citizen, a stateless person, and also from a Russian organization, the participants and (or) founders of which are the indicated persons to the federal executive body exercising the functions of control and supervision in the field of mass media, mass communications, information technology and communications;
  • comply with the rules for the use of confidential information in accordance with Art. 41 of the Media Law.

4.3. The Editorial Team have no right to:

  • disclose information provided by citizens in distributed messages and materials on condition of keeping them secret;
  • disclose the source of information and name the person who provided the information on condition of non-disclosure of his name, except for the case when the relevant request was received from the court in connection with the case in its proceedings;
  • disclose information in the distributed messages and materials that directly or indirectly indicate the identity of a minor who has committed a crime or is suspected of committing it, as well as who has committed an administrative offense or antisocial act, without the consent of the minor himself and his legal representative;
  • disclose in the distributed messages and materials the information specified in Part 6 of Art. 4 of the Law on Mass Media, unless the dissemination of such information is carried out in order to protect the rights and legitimate interests of a minor who has suffered as a result of illegal actions (inaction).

4.4. The Editorial Team is not obliged to respond to letters from citizens and forward these letters to those bodies, organizations and officials whose competence includes their consideration.

4.5. No one has the right to oblige the Editorial Team to publish a work, letter, other message or material rejected by it, unless otherwise provided by the Law.

4.6. The Editorial Team is responsible for violation of the legislation of the Russian Federation on the mass media.

 

5. Property and financial relations between the Founder and the Editorial Team

5.1. The property is used by the Editorial Team is an integral part of the property of the Founder. The decision to endow the Editorial Team with this or that property is made by the management bodies of the Founder in accordance with their competence.

5.2. The funds required for the production and publication of the mass media are allocated by the Founder in accordance with the estimated editorial costs at the suggestion of the Editor-in-Chief.

5.3. The procedure for the production, placement and distribution of advertising in the mass media is determined by the documents of the Founder. The amount of advertising in a separate issue of the mass media is determined by the Founder's management bodies in accordance with their competence.

5.4. The profit received as a result of the activities of the Editorial Team is the property of the Founder and is used by him to reimburse material costs for the production and release of the mass media, the implementation of mandatory payments and deductions and for other purposes in accordance with the Charter and documents of the Founder.

 

6. Editorial management

6.1. Management of the Editorial Team is carried out by the management bodies of the Founder and the editor-in-chief within their competence established by this Charter and other documents of the Founder.

6.2. The management bodies of the Founder, within their competence established in the Charter and other documents of the Founder, resolve the following issues of the Editorial Team:

  • determine the main directions of the Editorial Team's activities;
  • create and liquidate mass media headings;
  • make decisions on the placement of information in the mass media;
  • approve and dismiss the Editor-in-Chief, conclude an agreement with him, which defines the rights, duties and responsibilities of the Editor-in-Chief;
  • approve the annual reports of the Editor-in-Chief on the activities of the Editorial Team and on the use of funds and property allocated to the Editorial Team;
  • resolve issues of hiring and dismissing employees of the Editorial Team, conclude labor and other contracts with journalists and other employees of the Editorial Team;
  • allocate the necessary financial and material resources for the production and release of mass media, approve the estimate of the Editorial Team;
  • exercise other powers in accordance with the Charter of the Founder.

6.3. The Editor-in-Chief manages the current activities of the Editorial Team. The Editor-in-Chief is appointed and dismissed on the basis of the order (decree) of the Founder. The Editor-in-Chief in his activities is guided by the legislation of the Russian Federation, as well as the Charter and other documents of the Founder and this Charter. The Editor-in-Chief is responsible for meeting the requirements for the activities of the mass media by the legislation of the Russian Federation.

6.4. The Editor-in-Chief, within the limits of his competence, manages the Editorial Team on the basis of the principle of one-man management and independently solves all issues related to the activities of the Editorial Team, with the exception of those referred by this Charter to the competence of the Founder's management bodies.

6.5. The Editor-in-Chief:

  • represents the interests of the Editorial Team in relations with the Founder, publisher, distributor, citizens, their associations, organizations and in court;
  • organizes the work of the Editorial Team, approves the staff, issues orders and gives instructions that are binding on the employees of the Editorial Team;
  • distributes duties among the employees of the Editorial Team, approves the job descriptions of the employees of the Editorial Team;
  • defines the functions of the departments of the Editorial Team;
  • decides on the formation of the Editorial Team and on its dissolution, appoints and dismisses the members of the Editorial Team;
  • decides on the selection of external reviewers for work in the mass media;
  • signs each issue of the mass media for publication;
  • resolves other issues referred to its competence by this Charter, as well as by the Charter or other documents of the Founder. The Editor-in-Chief exercises the rights and performs duties in accordance with the Job Description approved by the Founder.

6.6. The Editor-in-Chief has the right to form the Editorial Team and the Editorial Council of the mass media by approving the regulations on them. The decisions of the collegium (Editorial Team) are of a recommendatory nature.

6.7. Members of the Editorial Team are appointed and dismissed by the decision of the Editor-in-Chief. The Editor-in-Chief is a member of the Editorial Team ex officio. The editorial team is convened by the Editor-in-Chief as necessary to discuss issues related to the production and release of the mass media. The Editor-in-Chief presides over the meetings of the Editorial Team.

6.8. The agenda is determined by the Editor-in-Chief. Members of the Editorial Team have the right to demand that additional issues be included in the agenda. This requirement can be received both before and at the meeting of the Editorial Team.

6.9. A meeting of the Editorial Team is competent if attended by more than half of the members of the Editorial Team, including the Editor-in-Chief. Decisions are taken by a simple majority of the members present and approved by the Editor-in-Chief. The Editor-in-Chief is not obliged to justify the refusal to approve the decision of the Editorial Team. The editorial Team is not entitled to discuss and make decisions on issues referred to in this Charter to the jurisdiction of the Founder's management bodies.

Powers of the technical community of the Editorial Team

6.10. The technical community of the Editorial Team consists of persons who, on the basis of an employment contract with the Founder, carry out editing (literary, scientific, artistic, technical), translation and layout of materials (text and illustrated) for the mass media.

6.11. The technical community of the Editorial Team takes part in the development and preparation of editorial plans, participates in the events of the Editorial Team, makes proposals to the Editorial Team management to improve the quality of the mass media and accelerate the editorial and publishing process. The technical community of the Editorial Team, together with the Editorial Team, adopts the Articles of Association of the Editorial Team, which is subject to approval by the Founder.

6.12. The meeting of the technical community of the Editorial Team is competent if attended by at least two-thirds of the members of the Editorial Team collegiums. Decisions are made by a simple majority of votes of the members of the Editorial Team present at the meeting.

6.13. The meeting of the technical community of the Editorial Team elects a chairman and a secretary from among its members, who draws up the minutes of the meeting. The minutes are kept at each meeting of the Editorial Team. All decisions of the meeting are recorded in the minutes. The minutes are signed by the presiding officer and the secretary.

6.14. The meeting of the technical community of the Editorial Team is not entitled to discuss and make decisions on issues that are not within its competence in accordance with this Charter.

 

7. Grounds and procedure for termination and suspension of mass media activities

 

7.1. The activities of the mass media may be terminated or suspended by the decision of the Founder or by a court in the order of administrative proceedings upon the claim of the registering authority (as amended by Federal Laws dated June 29, 2004 No. 58-FZ, dated March 8, 2015 No. 23-FZ).

7.2. The Founder has the right to terminate or suspend the activities of the mass media only in the cases and in the manner provided for by the Charter of the Editorial Team.

The basis for the termination of the activities of the mass-media by the court are repeated violations by the Editorial Team of the requirements of Article 4 of the Law "On Mass Media" within 12 months, about which the registering authority issued written warnings to the Founder and (or) the Editorial Team (Editor-in-Chief), as well as failure to comply with the suspension of mass-media activities if:

  • the Editorial Team has violated the requirements of the legislation on the mass media, the norms of journalistic ethics or this Charter again after receiving a warning from the Founder;
  • mass media publication is unprofitable;
  • the Founder has lost the ability to finance the release of the media;
  • production and release of mass media are recognized by the Founder as inexpedient for other reasons.

The decision to terminate or suspend the activities of the mass media is made by the Founder after consultation with the Editorial Team.

The activities of the mass media can be terminated in the manner and on the basis provided for by the Federal Law "On Counteracting Extremist Activities". The activities of the mass media may be suspended due to violation of the rules established by Article 19.1 of the Law "On the Mass Media" by a court decision in the manner of administrative proceedings at the request of the registering authority.

7.3. If the Founder decides to terminate the publication of a mass media bulletin, the Founder reserves the right to resume the publication of a mass media bulletin with the same name.

7.4. The adoption by the Founder of the decision to terminate the activities of the mass media entails the invalidity of this Charter. The editorial Team in this case is subject to liquidation.

7.5. In case of violation by the Founder of the Charter, the Editorial Team has the right to raise this issue with the management bodies of the Founder.

 

8. Transfer or retention of title

8.1. The right to the name of the mass media belongs to the Founder. The mass media logo can be registered by the Founder as a trademark in accordance with the legislation of the Russian Federation. In the event of a change of the Founder, including in the event of the reorganization of the Founder, the right to the name passes to its legal successor.

8.2. The transfer of the right to the name is secured by making changes to the register entry of the mass media by submitting an application to the registering authority

 

9. Consequences of a change of Founders, changes in the composition of Founders

9.1. In the event of a change of the Founder, the mass media continues its activities after re-registration in accordance with the procedure established by law.

9.2. In the event of the reorganization of the Founder, his rights and obligations in full are transferred to the legal successor. In case of liquidation of the Founder, his rights and obligations are transferred in full to the Editorial Team.

 

10. Procedure for approving and changing the Charter of the Editorial Team

10.1. The Charter of the Editorial Team are adopted at the meeting of the Editorial Team by a majority of votes in the presence of at least two-thirds of its members and approved by the Founder.

10.2. Changes and additions to the Charter of the Editorial Team are made by the Founder on his own initiative and at the suggestion of the Editorial Team. At the same time, changes and additions to the Charter of the Editorial Team affecting the rights of the Editorial Team are made subject to their approval by the meeting of the staff of the Editorial Team, and concerning the status of the Editorial Team, relations between the Editorial Team and the Founder and management of the Editorial Team - with the consent of the Founder.
